GENERAL TERMS AND CONDITIONS

1. INTRODUCTION

These terms and conditions govern the use of the websites www.zizzowatches.com, www.zizzowatches.ch, www.zizzowatches.de and www.zizzowatches.at . They constitute a contract between the buyer and LUREX Group AG (company number CHE-109.698.447), Sennhüttenstrasse 6, 8907 Wettswil, Switzerland (hereinafter referred to as “LUREX”). By making a purchase on this website or otherwise making use of this website, buyers agree to these terms and conditions. Buyers are individually responsible for ensuring that they have read and understood these terms and conditions prior to any use of said sites.

2. CONFIRMATION

Once LUREX has received an order from buyers, confirmations are sent to the email addresses they provide. It is therefore important to provide the correct email address when placing orders. We recommend storing the confirmation email in order to facilitate contact with customer service. In addition, the order confirmation serves as your proof of purchase or receipt.

3. PAYMENT OPTIONS

3.1. In the online shop found at www.zizzowatches.ch payment is accepted in the following forms: Swiss Post Card, credit cards (MasterCard and Visa), or PayPal. In the online shop found at www.zizzowatches.de and www.zizzowatches.at, payment is accepted in the following forms: credit cards (MasterCard and Visa) or PayPal. All payment transactions are handled by the Swiss PostFinance and the relevant card issuers or SIX Payment Services. LUREX reserves the right not to offer every payment method for every order and to ask buyers to use other payment methods.

3.2.Buyers agree to receive their invoice and vouchers in electronic form; physical copies of invoices may also be issued on request.

4. CARD PAYMENTS

4.1. The payment interface ensures secure payment processing in our online shops.

4.2. Buyers’ credit card details are sent directly to their bank and can only be read or accessed only by their bank.

4.3. For card payments, only those charges leveled for accepting that form of payment are passed on directly.

4.4. When paying by credit card, the initial conditions apply as soon as the transaction is approved.

If paying by credit card, it will be charged once the order is finalized. If no payment is received within the stated deadline after placing an order, LUREX may automatically cancel the order.

4.5. In the event of a chargeback, LUREX is authorized to provide SIX Payment Services with a copy of the order confirmation etc.

4.6. Buyers should be aware that LUREX accepts payments only from accounts in Switzerland and the European Union (EU). In no cases will LUREX cover the costs of a money transaction

5. CONDITIONS

5.1. All prices listed in Swiss francs on the www.zizzowatches.ch website include 8% VAT. All prices listed in Euros on the www.zizzowatches.de and www.zizzowatches.atwebsites do NOT include the VAT applicable in each country. Special VAT rates and customs duties apply to shipments outside Switzerland.

Orders sent outside Switzerland may incur customs duties or other fees. These are the sole responsibility of the buyer.

5.2. LUREX reserves the right to adjust any or all prices at any time.

6. ORDERING

6.1. Orders on behalf of another person, but placed without their consent, or orders which result in some other form of financial harm to LUREX will be reported to the police.

6.2. LUREX may not take advantage of any errors that would be to the buyer’s detriment. In case of wrong entries (for example, obviously incorrect prices or quantities), LUREX is obliged to cancel the order and refund any amounts paid whenever possible. This can be done at any time.

7. WARRANTY

7.1.  The warranty period lasts for at least two years from the date of purchase. Product-specifc warranty period can be found in the product description in the onlineshop www.zizzowatches.com.
This warranty covers manufacturing defects in the watch (the movement, the case, the watch glass).

7.2. For warranty inquiries or service, buyers should send an email to LUREX support (support@zizzowatches.ch). The following information must be included in such emails: the name and address of the purchaser, the order number, and a detailed description of the problem. Make sure to include the phrase “Warranty Claim” in the email subject line.

Among others, the following are not covered by the warranty:

  • – Damage caused by improper use or neglect (knocks, dents, breakage, broken glass, etc.)
  • – Damage caused by fire, water, or natural disasters such as earthquakes
  • – Changes that occur under normal wear and tear and aging (for example, minor scratches on the glass and/or housing, discoloration of the watchband, or peeling of the coating)
  • – battery replacement
  • – and similar

On the basis of the warranty, buyers are entitled to a free replacement in accordance with these conditions provided that the claim is filed within the stated period. All other forms of legal redress available to customers remain unaffected. Case, dial, hands, glass, watchband, or other parts may be replaced with equivalent products, however, if there are no originals are available.

8. PRIVACY

8.1. The data collected during the use of our online shops is stored in the LUREX database to help fulfill any and all orders placed. LUREX will treat all personal information as strictly confidential. Buyers have the right of access to their data and to require it to be changed or deleted as desired.

8.2. LUREX can place and use cookies.

9. PRODUCT RANGE

9.1. LUREX reserves the right to adjust prices and fees at any time and to change product information, images, and offers without notice.

9.2. The products featured in all of our online stores have been depicted as well as possible by means of product images and descriptions. The accuracy of the images may vary depending on the color settings of the user’s device (computer, tablet, smartphone, etc.). All photos are therefore non-binding illustrations and a correct representation of the product properties is not guaranteed.

9.3. No liability is accepted for any mistakes on the www.zizzowatches.ch, www.zizzowatches.de or www.zizzowatches.at websites.

10. DELIVERY

10.1. LUREX ships its goods worldwide. Deliveries are made in collaboration with Swiss Post and/or the postal services and their partners in the respective countries.

10.2. LUREX uses priority shipping as a rule. Should unforeseen circumstances make it impossible to use priority shipping, the item will be sent using economy shipping instead.

10.3. LUREX ships all orders valued at CHF 100 or more free of charge within Switzerland. LUREX also covers the shipping costs of all orders valued at €100 or more when delivered abroad. Shipping costs are passed on to the buyer for orders of €100 or less.

11. RETURNS UP TO 30 DAYS AFTER RECEIPT

11.1. LUREX voluntarily accepts returns of all purchases within 30 days. Buyers may withdraw from their purchase agreement by returning their purchase to LUREX within 30 days of receipt. A timely dispatch is sufficient to meet the deadline. However, this right of return only applies to goods that are unused and in their original packaging. Once you remove the protective film on the glass and the battery cover, the watch is no longer in its original packaging. LUREX reserves the right to send any returned goods that have been used or which are not in their original condition back to the buyer and to bill the buyer for the same, either in whole or in part. If buyers wish to exercise their right to return their purchase, they must first notify LUREX.

11.2. The costs and the risk associated with a return are fully borne by the buyer.

11.3. If buyers no longer wish to accept delivery of an order which has been delayed, they may cancel the order properly. If the ordered goods have already been shipped, buyers are obliged to accept delivery. The return must then be made as described above within 30 days.

11.4. If an item is no longer available, LUREX has the right to cancel the order and refund the amount paid to the buyer. LUREX must inform the customer if the item has been replaced or equivalent items are available.

12. COMPLAINTS

12.1. Buyers are solely responsible for checking the accuracy of the goods delivered and their condition. If no report is made to LUREX within 48 hours after receipt of the goods, the goods will be deemed by LUREX to have been inspected and to have arrived undamaged. After such time, the buyer is no longer entitled to withdraw from the contract.

12.2. If the goods were damaged in transit, the delivery service and LUREX (via email) must be notified within 48 hours of receipt of goods. If this deadline is not met, customer service must be notified via email must with reasons for the delay.

12.3. For all returns, the product must be packaged in such a way that damage during the return can be excluded.

12.4. If an item is no longer available, LUREX has the right to cancel the order and refund the amount paid to the buyer. LUREX must inform the customer if the item has been replaced or equivalent items are available.

13.⇥STATUTORY RIGHT OF WITHDRAWAL

13.1. Buyers making a purchase from any of the zizzowatches online shops have a statutory right of withdrawal:

They have the right to revoke this contract within fourteen days without specifying any reasons. The period of revocation shall be fourteen days from the date on which they or a third party they designate, who is not the carrier, have taken possession of the last product.

To exercise your right of withdrawal from this agreement, the buyer must expressly notify Lurex Group AG, Sennhüttenstrasse 6, 8907 Wettswil am Albis, Telephone: 0041 (0) 818 63 28, E-Mail support@zizzowatches.ch with a clear statement (e.g. by letter, fax or e-mail) of their intention to withdraw from this agreement.

If the buyer exercises this right, LUREX will confirm the receipt of this request via email. To meet the withdrawal deadline, it is sufficient for buyers to send their notice concerning their exercise of the right of withdrawal before the withdrawal period has expired.

13.2. If a buyer cancels this agreement, LUREX will immediately refund all payments received from you, including delivery costs (with the exception of the additional costs arising from the fact that the buyer chose a different method of delivery than that offered by LUREX), at the latest within fourteen days from the date on which the notification has been received regarding their cancellation of this contract with LUREX. For this refund, LUREX will use the same method of payment that the buyer used in the original transaction, unless expressly agreed otherwise with the same. Under no circumstances will buyers be charged fees for this refund.

LUREX may refuse to pay the refund until the goods have been returned or until the buyer has provided evidence of their return, whichever comes first.

Buyers must immediately send back or hand over the goods to LUREX, in any event no later than fourteen days from the date on which they sent notice of their withdrawal from this contract.

The deadline shall be considered met if the buyer sends back the goods before the period of 14 days has expired. The buyer shall always bear the cost of returning the goods.

The buyer is only liable for any potential reduction in value of the items if this reduction in value is due to their handling of the items such as was not necessary for testing the quality, characteristics, and functioning of the same.

14. LIABILITY

14.1. The liability of LUREX for errors in connection with the delivery is limited to existing conditions of sale. LUREX bears no direct or indirect responsibility for incompatibility, delivery delays, downtime, data loss, additional work, or other economic harm.

15. FORCE MAJEURE

15.1. LUREX is not liable for any damages that prevent, delay, or make fulfillment of the contract unreasonably difficult. These include government intervention, new or amended legislation, statelessness, war, fire, flood, labor disturbances, bans, restrictions, sabotage, poor transport, and weather conditions, inadequate delivery by suppliers, and criminal activities of which the company is a victim.

16. WARRANTY AND COMPLAINTS MANAGEMENT

16.1. The statutory warranty provisions apply.

16.2. We value customer satisfaction. Buyers may contact us any time. LUREX will endeavor to examine any concerns as quickly as possible and will respond to the buyer once the corresponding documents or other input has been received. If making a complaint, buyers are asked to describe the problem or deficiency as accurately as possible and to send copies of the relevant order documents. If no response is received from LUREX within 5 working days, please enquire.

17. INTELLECTUAL PROPERTY RIGHTS

17.1. All intellectual property rights, such as trademarks and copyrights, for websites and material published there are the property of LUREX or its affiliates or licensors. Any use of the websites www.zizzowatches.ch, www.zizzowatches.de and www.zizzowatches.at (and all shops to be added in the future) or their contents, including the total or partial copying or storing of this content, may only be done for personal and non-commercial purposes without the permission of LUREX.

18. USER CONTENT

18.1. All of our websites may make use of user-generated content, e.g. that posted on social media. LUREX claims no rights to this content (pictures, photos, videos, etc.) and is not liable for the same.

19. RETENTION OF TITLE

19.1. All items remain the property of LUREX Group AG until full payment is received.

20. FRAUD

20.1. In all cases of fraud reported to the police, LUREX reserves the right to cancel the order if deemed suspicious.

21. PLACE OF PERFORMANCE AND JURISDICTION/APPLICABLE LAW

21.1. The place of performance and jurisdiction is Zurich, Switzerland. LUREX is also entitled to seek legal redress at the buyer’s workplace or home.

21.2. These terms and conditions and the use of the site www.zizzowatches.ch, www.zizzowatches.de and www.zizzowatches.at are subject to Swiss law. Applicable law is Swiss law, in particular the Swiss Code of Obligations.

22. TERMINATION

22.1. LUREX reserves the right to cancel an account at its discretion and/or prohibit the use of its websites. This may occur if LUREX suspects that these terms and conditions have been violated. Such termination may occur without notice.

23. AMENDMENT OF THESE TERMS AND CONDITIONS

23.1. LUREX has the right to change these terms at any time. Notice will not be provided to customers about any changes made by LUREX. For each order or contract between the buyer and LUREX, the currently applicable terms and conditions as amended apply.

24. SEVERABILITY

24.1 Should one or more provisions of this contract be wholly or partially invalid, or should the contract contain loopholes, the validity of the remaining provisions or parts of such provisions shall be unaffected. The ineffective or missing provision shall be replaced by the respective legal regulations.
